Independent Counsel law improvements for the next five years
Article Abstract:
The Ethics in Government Act of 1978 will expire in June 1999 unless Congress renews it. The law's original rationale should not be forgotten: to provide a mechanism for defeating executive branch interference with law enforcement, and to protect public trust in law enforcement. Nor should the law's successes be forgotten. Although serious constitutional issues still bedevil this law, these matters could be resolved by amending the law rather than by allowing it to expire.

The NLRB's (slowly) developing Beck jurisprudence: defending a right in a politicized agency
Article Abstract:
Reasons for the delay in NLRB enforcement of union security agreements since the Supreme Court's ruling in Communications Workers of America v. Beck are discussed. The NLRB should implement rigid, new rules on union security agreements under the authority granted by the administrative procedure act, as Beck rights have strong First Amendment concerns.
