Lawyer publicity in the European Union: bans are removed but barriers remain
Article Abstract:
Most European Union Member States allow attorneys to advertise, a sharp departure from traditional restrictions. However, inconsistencies between states' advertising rules create problems for cross-border attorney practices, especially when attorneys have to obey both home and host-state rules. Home-state rules can raise conflict-of-law problems as well. A uniform policy asserting the governance of home-state rules would be useful. Ideally, the Lawyers Establishment Directive and the code of the EU's bar association representative body should mandate control by host-state rules.

Article Abstract:
The Florida Bar's ban on soliciting injured potential clients, recently upheld by the US Supreme Court, is not entirely reasonable. It seems elitist, for it applies only to lawyers who would represent the unsophisticated or those who do not immediately know when they might need a lawyer. It also is one-sided, applying to would-be plaintiff's lawyers but not to representatives of insurance companies or their clients. Bars should instead focus on making stronger the existing laws against unethical legal practices.

Article Abstract:
Law firms are increasing their advertising. Name recognition is the primary reason for the increase in law firm marketing budgets. The reluctance to advertise is decreasing because law firms must distinguish their services from other professional service organizations such as accounting firms.
