Liability for psychiatric illness
Article Abstract:
The Law Commission recently issued a consultation paper on liability for psychiatric illness, currently a topic of much popular concern due in part to secondary victims of the Hillsborough tragedy. The commission concluded that the law should be reformed regarding secondary victims by dropping the current requirements of proximity in space and time and of directly witnessing the triggering event when the plaintiff is emotionally close to the primary victim. Seven principles of liability are outlined.
