The covenant of good faith and fair dealing: responsibilities of first-party insurers
Article Abstract:
Insurance companies fear court judgements of bad faith, while persons who are insured fear denial of a claim. However, courts have tended to rule that if an insurance company uses reasonable caution when investigating a claim and researching the law, extra-conditional damages are usually not awarded. The focus when examining claims of bad faith should be on the insurer's procedures for accepting or rejecting claims.
