Litigation on implants moves to new frontier; jury says Dow Chemical is liable for silicone of related company, Dow Corning
Article Abstract:
An Oct 28 verdict awarding $14.1 million against Dow Chemical is the first to find that industrial giant solely liable for injuries caused by breast implants made by Dow Corning. Dow Chemical is a joint-venture partner and shareholder in Dow Corning, which recently sought Chapter 11 protection. Dow Chemical also began trial on Nov 1 in Detroit against 43 insurers, and was ordered on Nov 2 by the TX Supreme Court to stand trial, with 150 cases immediately involved and potentially thousands more.

Did Bronco class counsel roll over and settle? A judge, saying collusion possible, overturns a settlement - a sign of growing scrutiny of class actions
Article Abstract:
Challengers to class-action settlements were heartened by a decision to overturn a settlement regarding Ford's Bronco II trucks on the grounds of possible collusion. The settlement would have given plaintiffs only warnings, but $4 million to their counsel. The incident followed the rescinding of a class in a blood-products case, made to protect the defendants from potential bankruptcy. Courts in general are revisiting the issue of Rule 23 as mass torts swell in number.

The breast implant litigation community is divided over the issue of a massive class action suit spearheaded by Cincinnati, OH, practitioner Stanley M. Chesley. Chesley's opponents have filed for decertification of the class action suit and petitioned for a consolidated multidistrict litigation. Cincinnati US District Judge Carl B. Rubin, who certified the class action quickly and without a hearing, has been accused of favoritism towards Chesley.
