Mandatory arbitration clauses: an analysis of Supreme Court decision in Wright case
Article Abstract:
The Supreme Court, in Wright v. Universal Maritime Service Corp. in 1998, ruled that employee waivers of the right to litigate rather than arbitrate statutory discrimination claims must be clear and unmistakable. The Court thus failed to resolve the larger issue of whether collective-bargaining agreements may contain mandatory arbitration provisions. Wright does show that such provisions will be held to high standards of clarity by the courts and hence must be written with great care.
