Nanny takes appeal bet; rescued from one bad gamble, British au pair and legal team roll dice again

Defense lawyers for British au pair Louise Woodward have filed an appeal for a new trial, not satisfied with Judge Hiller Zobel's decision to downgrade the murder conviction to voluntary manslaughter and free Woodward from prison. They hope that this new trial will bring acquittal, but other criminal defense lawyers caution against such a gamble, saying that the new-trial motion is unlikely to convince an appeals court and Woodward could be returned to prison.

The Nanny jury tried to do right without knowing all it should

Massachusetts Judge Hiller Zobel usurped the jury's job in the Nanny murder trial. He contradicted the jury and found that Woodward's acts held no malice when the jury had found the opposite. At one time, juries were important in sentencing but today are told tat sentencing consequences are something they cannot consider. As a result, the verdicts are reached uninformed and often with results the jury never would have advocated.
