'Vitrionics' sets road map for patent construction; the Federal Circuit ruled that if a claim term in unambiguous, extrinsic evidence is barred
Article Abstract:
The US Court of Appeals for the Federal Circuit ruling in Vitronics Corp. v. Conceptronic, Inc. concerned a patent for the reflow soldering of service-mounted devices to a printed circuit board and detailed what evidence a trial court can consider in deciding patent claims, deciding on a division between intrinsic and extrinsic evidence. The Federal Circuit reversed the district court and held that when the claim term based on the intrinsic evidence lacked ambiguity, extrinsic evidence could not be considered. The Federal Circuit in this case constructed a road map for trial courts with patent claims.

On-sale bar requires a more complete invention; the Federal Circuit narrows the definition of when an invention is put on sale, barring a patent
Article Abstract:
The US Court of Appeals for the Federal Circuit ruled in Micro Chemical, Inc v Great Plains Chemical Co, Inc that an inveotr must have "substantially completed" an invention and demonstrated confidence that it would fulfil its intended purpose to establish the on-sale bar doctrine. In its May 1, 1997 ruling in Robotic Vision, Inc v View Engineering the Federal Circuit further narrowed this doctrine, ruling that elements necessary to the invention but not claimed in the patent should also fulfil this requirement. The impact of these decisions is unclear.
