Partnering and the management of construction disputes
Article Abstract:
Construction disputes involving owners, contractors, designers, subcontractors, and others can be prevented from leading to litigation through a combination of partnering and dispute management. The first step is the establishment of partnering, based on shared commitment to a common mission, as the basis for the working relationship among the groups cited above. The second step is to agree on and execute a plan for dispute management based on total quality project management and other techniques.

Resolving public sector disputes: a road of politics and potholes
Article Abstract:
Mediation with public sector entities can result in challenges for members of the construction industry. In such mediation, open meeting and bureaucratic requirements not present in ordinary mediation may have to be dealt with. If the private sector party makes itself aware of these requirements and provides for mediation soon after disputes develop, settlements can be easier to obtain.
