Patent fee diversion crosses constitutional boundary
Article Abstract:
The author argues that the funding of the US Patent and Trademark Office through user fees acts as a special tax against owners of intellectual property and violates the Intellectual Property Clause of the Constitution. Precedents from the early English patent law system are discussed.

The Plant Patent Act of 1930: a sociological history of its creation
Article Abstract:
The Plant Patent Act of 1930 (PPA), which provided asexually reproduced varieties of domesticated plants with patent protection, is discussed placing the law within the social, scientific and legal context of its day. Lobbyists equated the PPA with mechanical invention.
