Patenting and ethics - a dubious connection
Article Abstract:
The patenting of DNA and stem cell research has created a demand to insert ethical considerations into international patent law. Reports on ethics in these fields of patent law by Nuffield Council on Bioethics and the European Group of Ethical Advisers to the European Commission are considered. It is concluded that making patent law subject to ethical questions is not necessarily a positive development.

Written description after Enzo Biochem: can the real requirement step forward please?
Article Abstract:
The US Court of Appeals for the Federal Circuit case of Enzo Biochem, Inc. v. Gen-Probe Pharmaceutical Co. has brought up questions relating to the interpretation of the written description requirement in the patent process. The best way to clarify this requirement would be to limit it to cases where patent priority is an issue.

Back to the future: rethinking the product of nature doctrine as a barrier to biotechology patents
Article Abstract:
The product of nature doctrine states that subject matter found in nature is not patentable. This doctrine has generally been ignored in the granting of biotechnology patents, but it should not have been. Its applicability to biotechnology patents is examined.
