Two New York Supreme Court cases are discussed, Tancredi v. A.C. & S., Inc. limiting the damages payable by asbestos industry defendants who are in bankruptcy, and In re New YorkCity Asbestos Litigation,which had claimants with minimal impairment litigate in a 'deferred docket.'

State courts' differences of opinion regarding whether liability insurance covers buildings as products of developers or contractors is discussed. The Alaska Supreme Court's ruling on this issue in Fejes v. Alaska Insurance Co is discussed in some detail.
