Recognition and enforcement of state contract awards in the United States: a restatement
Article Abstract:
US rules on state contract award recognition and enforcement are generally more favorable than those of other nations, so parties in contract negotiations should ask for choice-of-forum clauses and immunity waivers, as well as arbitration clauses. International arbitration has generally been found acceptable to US courts, which have been much fairer in such matters than is usually perceived. The Foreign Sovereign Immunities Act provides clarity on issues of personal and subject matter jurisdiction, but more importantly, balances state and private interests on immunity issues.

The ILC adopts a statute for an international criminal court
Article Abstract:
The International Law Commission has adopted a Draft Statute for an International Criminal Court at its 46th session in 1994. The statute incorporates features from various national legal systems and allows for coexistence with national criminal jurisdiction and the present system of international judicial assistance. The international court would have jurisdiction over crimes of genocide, aggression, crimes against humanity, and violations of the laws of armed conflict. The court would be permanent, and a treaty would be required for its establishment.
