Safety team laws may collide with the NLRA; pressure is mounting in Congress to pass legislation aimed at resolving this issue
Article Abstract:
The safety and health committees mandated by many state workers' compensation laws may conflict with federal laws protecting workers' freedom of association. The National Labor Relations Act states that employers cannot dominate labor organizations, so employers can get stuck with violating two federal laws at the same time. Sen Nancy Kassebaum, who chairs the Senate Labor Committee, has introduced legislation which would exempt these employee committees from NLRA Section 8(a)(2) prohibitions. The proposed Teamwork of Employees and Management Act has been passed by the House and would do the same thing.

Workers' compensation; national health care will not cure problems of state workers' compensation systems
Article Abstract:
The Clinton administration's proposal to integrate the workers' compensation and health insurance systems represents flawed thinking. The Clinton proposal does nothing for workers' compensation's worst problem, that programs are normally controlled by the physicians and lawyers they are affiliated with. Thus, these two professional groups have an economic stake in helping the employee stay off work as long as possible. Employers must have some control over the choice of the treating doctor and medical care if costs are to be kept down.
