Same-sex harassment suits on rise; 8th Circuit Title VII ruling in man-vs.-man case spawns a lower-court following
Article Abstract:
The US Court of Appeals for the 8th Circuit became with Quick v. Donaldson Co, Inc, the first federal appeals court to broaden the class of those able to bring a federal sexual harassment suit to include alleged sexual harassment of one heterosexual male by another. The court ruled that such suits can be filed under the Civil Rights Act of 1964's Title VII. Most federal courts since Quick have followed the decision. Quick held that the sexually offensive nature of the harassment rather than the gender of the parties determines whether a case comes under Title VII.
