The importance of calm, purposeful pretrial preparation for trial attorneys faced with an opponent accustomed to pushing the ethical envelope is discussed. Judges can be expected to exert pressure towards a realistic settlement on such opponents.

A trial lawyer's careful selection of cases is stressed. Many cases depend on facts almost impossible to prove, and the client should understand out the outset that staying with the case will depend on what can be learned in discovery and trial preparation.
