Storm leaves a lot of suits in its wake
Article Abstract:
Structural engineers examining the damage caused by Hurricane Andrew contend it shows years of building practices below the standards of the South Florida Building Code. The bulk of the suits will probably be against home builders and real estate developers, but some litigation between homeowners and insurance companies may also take place. The builders could be judged by the strict liability standard if their buildings did not meet code requirements. Of the defenses the builders might use, Florida's economic loss rule may be the strongest, and others include statute of limitations and causation.

Grand jury witnesses get help
Article Abstract:
Florida is the most recent state to pass a law that permits witnesses appearing before grand juries to have their attorneys present in the hearing room. Defense lawyers applaud the law, while prosecutors fear that indictments could be jeopardized by unethical defense lawyers. California and other states have similar legislation pending.
