Stroking the Nettle: New Zealand legislators and the issues of redundancy
Article Abstract:
The issue of judicial activism in New Zealand is discussed considering that New Zealand has experienced considerable redundancies for the period of over 20 years as a consequence of recession and major restructuring of the economy. A combination of New Zealand's personal grievance procedures in its industrial relations legislation, together with its lack of explicit legislation on redundancy, has enabled all levels of the judiciary from lower level committees, specialist industrial relations Courts, and the Court of Appeal tempering or reversing, and at times also reinforcing, the activism.
