Breakup of Microsoft not on the table; U.S. makes secret settlement offer, limited to conduct

Some of the negotiations for a remedy to the Microsoft antitrust case are given, and there has been no meeting of the minds to this point. The federal government's proposed conduct remedy focused on changing the computer giant's conduct toward customers, while the state attorneys general are thought to be those pushing for a corporate breakup.

Issues regarding Microsoft antitrust judge Thomas P Jackson's finding that the Microsoft Corp violated the Sherman Act by its anti-competitive conduct to protect its Windows system monopoly, as well as cornering one in the browser market. Microsoft plans to win on appeal and places its hope in a ruling in another federal case that the courts should not second-guess software design decisions.

Sullivan & Cromwell cross-exam goes on and on... Is Microsoft's trial counsel putting judge to sleep? Or does it have a master plan?
Article Abstract:
Sullivan and Cromwell, representing the Microsoft Corp in its 1998 antitrust trial, seems to be making potential points for the government case, having had a difficult time attacking the credibility of the government witnesses, and the government has released excerpts of Microsoft CEO Bill Gates's testy deposition. Sullivan and Cromwell is, however, creating a lengthy appellate record for the inevitable appeal in this case. Winning on appeal is the ultimate game plan, and Sullivan and Cromwell's appellate skills rate better than their courtroom talents.
