A New York court committee has recommended special ethical rules for family law practitioners. These include a prohibition of attorney-client sex during a representation, a written fee agreement, a prohibition of non-refundable fees, restrictions on retaining liens and fee security agreements, and required fee arbitration. The proposals also include a client bill of rights. Some of the economic restrictions seek to restrict up-front charges of package fees so large that a client will be reluctant to discharge a lawyer.

Prospective clients can raise important ethical questions for most law firms, but few courts have ruled on the issues involved and the profession's ethical rules only allude to them indirectly. The potential client has an interest in being able to seek the best lawyer, necessarily revealing some information to each. The lawyer or firm must be able to gather information without that disqualifying it from future, adverse representations. How a firm handles the information in its conflict-checking system is crucial.

Professionalism can be thought of as the 'right stuff' in lawyers
Article Abstract:
A good description of the lawyer's goal is to provide independent judgment and do so with professionalism. Lawyers must make sure their independent judgment is not endangered by influence from other clients, third parties, government agencies or the lawyer's own interests. Professionalism comprises style and etiquette appropriate to a given situation.
