The employment at will doctrine: Nevada's struggle demonstrates the need for reform
Article Abstract:
The struggle between Nevada's judicial and legislative branches over the employment-at-will doctrine is but one example of an increasing nationwide judicial unwillingness to view the doctrine as inflexible. The implied contract exception to the doctrine and two tort exceptions, the breach of the implied covenant of good faith and fair dealing and the public policy tort, have been used to counter employment-at-will's inflexibility but are not an efficient and cost-effective solution to the problem. Legislation such as the Model Employment Termination Act is needed.

Quit and return: is it resignation or discharge?
Article Abstract:
The 'quit and return' situation is one which occurs fairly frequently for employers and case law on the subject shows certain guidelines to be helpful in assessing this type of situation. These include whether the employee took 'quit' actions, completed the relevant paperwork, had time to and did indeed seek another job, how immediate the revocation of the quit notice was, whether the employee was emotionally capable of resigning meaningfully and whether the employer has already acted on the employee's quit notice.
