The impact of trade practices law on disputes involving a sports league and its member clubs
Article Abstract:
The Australian Federal Court ruled in News Ltd. v. Australian Rugby Football League Ltd. that the League's attempt to bar the formation of a second league through loyalty agreements was a restraint of trade under the Trade Practices Act 1974 section 45. The court noted that the loyalty agreements were based on use of market power and thus constituted a barrier to new entry. The league argued that News Ltd. was attempting to take over and thus free ride on the league's investment.

Article Abstract:
The impetus to reform demonstrated in the Taxation Simplification Programme and the Corporations Law Simplification Programme may be extended to the area of corporate criminal responsibility. Revisions to the Australian Criminal Code being considered would allow inquiry into the culture of a corporation to determine whether unlawful practices were encouraged. Compliance policies may become a larger part of the Trade Practices Act enforcement scheme.

Vertical price and non-price restraints in Australia and the US: a comparative analysis
Article Abstract:
Both vertical price restraints (VPRs) and vertical non-price restraints (VNPRs) may have social welfare benefits and not need to be as regulated as they are in Australia and the US. Both countries have stricter regulations on VPRs than VNPRs, but the US recognizes that both may aid interbrand competition and has relaxed its ban on VPRs. Australian law permits both under notification and authorization procedures, which the US lacks.
