Revisiting the Robinson-Patman Act in the franchise supply setting
Article Abstract:
Franchisors and their counsel should develop a working understanding of the Robinson-Patman Act's price discrimination laws to ensure that pricing arrangements with franchisees do not violate the law. The Robinson-Patman Act proscribes the use of differential pricing that favors large buyers and harms competition among buyers. The elements that must be proved include at least two sales, competitive injury and actual injury. Indirect price advantages, such as advertising cost concessions, are also actionable under the law.
