Tort case as gag device
Article Abstract:
Wiesenthal v McCalden dealt with a tort suit for interference with contract in which freedom of speech was cited as a defense. The plaintiff wanted to rent exhibit space at the California Library Assn annual convention in which to espouse the theory that the Holocaust never happened. The Jewish community in Los Angeles, where the convention was to be held that year, complained and the association canceled the plaintiff's contract, after which he sued. The 9th Circuit found the rights of contract and tort more important than the constitutional right to freedom of speech of the defendants.

Policies covering advertising injuries may prove to be of limited benefit
Article Abstract:
Courts have rendered decisions both ways in cases involving insurance for advertising injuries, leaving little overall guidance on the issue. Courts found in favor of coverage in Zurich Insurance v Killer Music, Liberty Life Insurance v Commercial Union Insurance, and Tire Kingdom v First Southern Insurance. They found against the insured in Two Pesos v Gulf Insurance, Sentry Insurance v RJ Weber Co, and Parameter Driven Software v Massachusetts Bay Insurance. Policy purchasers should closely review the policy's language.

Condom makers battle in court; fear of trade secret leak
Article Abstract:
London International Group PLC v Carter-Wallace Inc is a battle between American and British condom makers over the employment of Dr. Michael Harrison, a scientist who allegedly knows trade secrets regarding natural membrane technology for condoms. If successful, these new natural membrane condoms would match the resistance to sexually transmitted diseases of the more widespread latex condoms. London International Group has alleged misappropriation of trade secrets and breach of contract.
