Tread carefully across state lines
Article Abstract:
The rule that attorneys cannot appear before the court of a state unless they are admitted pro hac vice or to the state's bar is universally recognized and usually enforced. Attorneys in one state can, however, give legal opinions on the law of another state. In practice, out-of-state lawyers feel quite comfortable rendering the whole gamut of legal services other than court appearances for out-of-state clients. There are very few court rulings on the matter and the most serious risk such attorneys run is probably the client's refusal to pay their fee on grounds of unenforceability of the contract.

Holly Towle, a partner at Seattle's law firm Preston Gates and Ellis LLP, put herself and her husband through law school by selling her stained glass at art fairs and spent her first 10 years as a lawyer working in commercial law. After gaining her legal expertise in tangible goods and services, representing software companies in the drafting of an electronic commerce code is a welcome challenge. Towle has been a Preston partner since 1986 and switched from the more traditional specialty of banking to intellectual property and electronic commerce in 1990.

Protectionism is alive and well in U.S. bar
Article Abstract:
The legal profession needs an agreement similar to NAFTA allowing free movement to other states without taking new bar exams and undergoing new character assessments. Many jurisdictions apparently raise such barriers to keep out lawyers from other states, with all but two requiring lawyers with less than five years' experience to start from scratch, and 26 demanding it of all lawyers. Ideally an attorney's passing score would be given credit in other states, and little additional character verfication demanded.
