Wrongful dismissal
Article Abstract:
Wrongful dismissal is a contract breach, subject to damages under UK law, and should be distinguished from unfair dismissal. Although misconduct can be the basis for justifiable summary dismissal, employers are liable for wrongfully repudiating employment contracts. Damages can be claimed to recover lost earnings, pension rights, fringe benefits, and share-option rights, although amounts may be reduced by other earnings. Discretionary remedies include injunctions and declarations. Civil courts and industrial tribunals have jurisdiction, although tribunal awards are limited to 25,000 pounds sterling.

Lay-offs and short-time working
Article Abstract:
An employee lay-off is the suspension of a labor contract when work is unavailable, and the contract is still in force but the employer neither provides the employee with work nor pays him according to the contract. The contract also continues during "short-time working," or working less time for proportionately less pay because of a shortage of work. Lay-offs and short-time working can be used instead of redundancies, but neither will necessarily avoid liability for redundancy payments. Remedies for wrongful lay-offs, rights to guarantee payments and other related topics are detailed.
