A European Court ruling has been interpreted by Lord Howell, the former Labour minister of sport, as indicating that the bundling of live, highlights, radio and other rights goes against European competition law. This has added further confusion to an already sensitive issue as preparations are made for the third reading of new Broadcasting Bill in the UK. If legal barriers to bundling cannot be erected, then the Sports Council may act to protect the government's stance by introducing a voluntary code for sharing rights.

It is possible under the terms of the new BBC charter for the organisation to be taken to judicial review by anyone who has a grievance against it, and for that person to receive legal aid to do so. This contrasts sharply with the previous situation, in which a challenge to the BBC could only be mounted under the Representation of the People Act. BBC governors are now also committed to ensure that sensitive issues are handled accurately and impartially.
