Government opposes Microsoft's request for a stay

Microsoft's filing for a stay of the ruling has been opposed by the Department of Justice. The government states that it is an attempt to prevent the trial from reaching the Supreme Court. The Expediting Act entails that an antitrust trial of public importance should be sent directly to the Supreme Court and this is an action that Judge Thomas Penfield Jackson favors.

U.S. argues against delay that Microsoft is seeking; sees no need to await Supreme Court ruling

The US Justice Dept.'s Antitrust Div. and 18 states are urging the US Court of Appeals for the District of Columbia not to grant a stay of court proceedings on the antitrust case against Microsoft Corp. Microsoft has asked for a stay, pending a hearing of the case by the US Supreme Court in Oct. 2001. The Justice Dept. avows that any delay in remedy proceedings to Microsoft's violations of the Sherman Act will cause uncertainty to consumers and the software industry.

Judge is assigned to decide Microsoft antitrust penalties
Article Abstract:
As Microsoft introduces its controversial Windows XP operating system, federal justice Colleen Kollar-Kotelly was randomly assigned to determine the proper remedies for Microsoft's previous antitrust violations. Most of the complex legal issues have been resolved already by a federal appellate court, which will leave Judge Kollar-Kotelly only the task of determining the appropriate punishment. She is expected to conduct hearings soon and will also consider whether Microsoft should be required to modify Windows XP over antitrust concerns.
