Agent liability and seller's representations
Article Abstract:
The California Court of Appeals in Robinson v. Grossman clarified the duties of real estate agents with regard to inspecting listed properties, verifying the description given, and disclosing defects. The Court found a minimum standard for agent disclosure, duty, and liability under California law. However, the case failed to resolve the ethical dilemma of whether agents should rely on sellers to provide accurate descriptions.
