Bring home the bacon
Article Abstract:
The case of Medforth v Blake highlights several important issues relating to the extent of receivers' duties. It was concluded that a receiver managing mortgaged property owes duties to the mortgagor and anybody else with an interest in the equity of redemption. The duties include, but are not necessarily limited to, a duty of good faith. Due diligence does not oblige the receiver to continue to carry on a business on the mortgaged premises previously carried on by the mortgagor.

Unreasonable refusal
Article Abstract:
Cases are discussed which demonstrate the principle that a landlord cannot refuse to consent to assignment of the lease solely on the basis that the proposed use breaches the terms of the lease. Refusal is only reasonable if the landlord can demonstrate that the proposed use would damage his interests as landlord.
