Issues concerning the impact of the Real Estate Notification and Disclosure Rule on the sale or lease of particular housing constructed before 1978 are discussed. Attention is also given to housing excluded from the Residential Lead-Based Paint Hazard Reduction Act of 1992.

Selling a principal residence upon which depreciation has been claimed

An examination of how current and prior tax law treats depreciation on the exchange or sale of a principal residence is presented. Provisions of the 1997 Taxpayer Relief Act significantly impact the exchange or sale of a home. Under the act, the gains of a principal residence sale that are attributable to depreciation are subject to taxation at up to a 25% rate.
