Flawed judgement
Article Abstract:
The UK Court of Appeal was incorrect in its decision to rule against the environmentalists occupying land required for a new airport runway, in the case between Dutton versus Manchester Airport PLC. The land was owned by the National Trust therefore according to previous rulings Manchester Airport, as a licensee, could not evict the protestors. The Court of Appeal also did not take into consideration the difference between possession and occupation of land when deciding the case.
