Highways and developments
Article Abstract:
Under the Highways Act 1980 and the Town and Country Planning Act 1990 it is possible to stop-up a highway, which may be a bridlepath, footpath or road. Developers have to apply for stop-ups if it is deemed necessary to divert the path of the highway for various reasons. When a highway is stopped-up the highway authority loses its rights to the surface and landowners resume rights to the land. The public has to be informed if local authorities or the state is intending to stop-up a highway.
