Telecommunications technology has become a competitive differential among commercial real estate owners. The question on which players in the commercial real estate capital markets can function as parents or controlling authorities is discussed. The candidates for parenthood considered are the primary mortgage market, public market, the capital market and the intermediaries. However, each of the candidates suffers some critical inadequacies to serve as market regulators. They are also shown to be too permissive.

Deferred exchanges: avoiding traps for the unwary

Article Abstract:

The use of tax-deferred exchanges in place of outright real property sales has been practiced since the latter part of the 1980s. This is due to the increase in the maximum capital gain rate and the implications of the Starker vs. US case which made possible valid exchanges on a nonsimultaneous basis. Some common practices that might invalidate an exchange transaction are presented.
