The art of deception
Article Abstract:
A case heard in the UK courts dealt with a problem under the UK Property Misdescriptions Act 1991. Lewin Trading Standards Office brought the case against Barratt Homes Ltd when it found some prospective house buyers were shown pictures of houses and visited a show house which turned out to be different from the house they were sold. The high court judges found Barratts to be at fault for showing incorrect pictures of houses despite the presence of a disclaimer. It is clear the 1991 Act was meant to apply not only to estate agents but to developers who sell their own properties.

Subject to contract - who pays?
Article Abstract:
A case between Regalian Properties and London Dockland Development Corporation highlighted the question of who should pay when a 'subject to contract' agreement breaks down. The case involved 2.9 million pounds of costs incurred for producing detailed designs for a development which never came to fruitition. It was held that such costs were a normal business expense related to property development, and liability was not transfered to the third party.
