The Religious Land Use and Institutionalized Persons Act: devil or angel?
Article Abstract:
The Religious Land use and Institutionalized Persons Act was passed in response to religious groups who complained that local government was using zoning laws to put undue restrictions on where they could worship. The law requires that compelling local government interests can only be advanced with a minimum of restrictions on any group. This law will have the salutary effect of requiring communication between religious groups and local government.

Let the seller beware: disclosures, disclaimers, and "as is" clauses
Article Abstract:
Most states will not recognize a provision in a real estate transaction contract that releases the seller from their duty of disclosure. Both public policy and the interests of parties in such a contract dictate that such clauses should be recognized. Justification can be found for this approach in the laws of tort and contract.

The pollution exclusion: a potentially undersused tool for insurers in the toxic mold morass

One way for the insurance industry to avoid homeowners' claims for toxic mold is to convince courts that mold falls under the pollution exclusion in existing policies. This strategy has had some success in state courts and could become increasingly common.
