Article Abstract:
The Contracts (Rights of Third Parties) Act 1999 will assist the UK property industry in a number of ways. It eliminates two of the main problems connected with section 56 of the Law of Property Act 1925. However, it will not make a substantial difference to the manner in which documents relating to freeholds, especially transfers, are structured. The provisions of this legislation cannot be fully exploited until the issue of enforcement of positive covenants against successors in title is addressed.

New procedures for negotiating property transactions
Article Abstract:
A number of changes have recently been made to the law on property contracts in Scotland. These include the simplification of procedures relating to written contracts and changes to the method of execution of documents and witness requirements. A partnership can now sign by one partner, and firms can authorise other persons who are not partners to sign.
