Brave changes, Lord Irvine, but will they do any good?
Article Abstract:
The UK government has attracted considerable controversy by indicating in its White Paper on the modernization of justice that legal aid will no longer apply to most personal injury cases. There is certainly a place for no-win, no-fee arrangements, but they have few connections with genuine reform of the justice system. There will be a facility to bring back classes of cases under legal aid, and this should take place as soon as possible. It is vital that the government ensures that the various elements that make up the public provision of access to legal services should link together.

Article Abstract:
It is becoming increasingly common in the UK for claims managers to handle civil disputes. Claims managers visit people in their own homes to discuss their claims, and in almost all cases are able to negotiate a settlement out of court. They are set to become more influential as the government makes plans to abolish legal aid for personal injury cases in 1999. The abolition of legal aid means that there will probably be fewer cases where large compensation settlements are awarded.
