Guinness assigns Panel to the dustbin of history

The UK government's report on the Guinness affair shows the Takeover Panel in a particularly poor light. Some observers believe that the future of the Takeover Panel is in doubt, especially as the Council of Ministers is shortly to review the European Commission's planned directive to harmonize takeover regulation across Europe on a statutory basis. It seems that the Takeover Panel's mode of operation may not be suitable to current activities in the City of London, where there has been a rise in the number of instances of questionable practice.

The recent trial of Kevin and Ian Maxwell, sons of the late Robert Maxwell, has highlighted the very dominating nature of this man. Today's commercial and investment bankers are less likely than their predecessors to be deceived by someone with the great charm and enthusiasm which Robert Maxwell possessed, but they have still not fully learned the lessons from what happened within his business empire. New standards of accounting and corporate governance have been introduced, but this does not mean that such a scandal could not happen again.

Davies expects the world to follow where his FSA leads

The UK will present a model for financial regulation to the rest of the world, according to Financial Services Authority (FSA) Chmn Howard Davies. This organization will bring together the work of the existing nine different industry regulators, and will have a a very wide range of responsibilities. Davies regards the concept of lead regulation as a key element in effective financial regulation of capital markets and organizations that are becoming increasingly global.
