No win, no fee. But will justice be the loser?

There are still mixed views about the arrangements for conditional fees, due to come into effect later in Jul 1995. Some people fear that they could lead to conflicts of interest between lawyers and clients. However, supporters of the new system, which is part of the Lord Chancellor's strategy for funding legal services, point out that it is not the same as the contingency fee arrangements in use in the US. In the UK, the lawyer will receive the usual fee plus an additional percentage increase, or 'success fee.'

The Solicitors Indemnity Fund (SIF) was set up in 1987 and is the required insurance for members of the Law Society. Its council recommended increasing contributions by 18% for two- and three-partner firms and 31% for sole practitioners on Jun 4 1992. Larger firms will have reduced contributions. Some large firms consider insuring themselves, but the Law Society is against this. SIF's maximum cover is 1 million pounds sterling and the calculations prevent one part of the profession subsidising another.

Sending out lures to business
Article Abstract:
The Lawyers for Enterprise scheme has been relaunched as Lawyers for Business. It provides small businesses with a free initial interview to encourage them to become regular clients. It can do more than individual firms in co-operation with enterprise agencies, business advice centres and the Federation of Small Businesses. Business work accounts for 28% of fee income.
