Racial discrimination in implementing the death penalty
Article Abstract:
Many studies reveal ongoing discrimination in the use of the death penalty, even after Furman v. Georgia ruled this to be unconstitutional in 1972. The US General Accounting Office found correlated with getting the death penalty in over 80% of the studies. Proportionality review and clemency proceedings are two potential final safeguards against this kind of discrimination. The curtailment of the habeas corpus writs and the defunding of resource centers make the rectifying of this discrimination less likely.

Beyond reason: executing persons with mental retardation
Article Abstract:
The extreme miscarriage of justice of capital punishment for the mentally handicapped is discussed. At least 35 mentally retarded defendants have been executed in the US since capital punishment was reinstated in 1976. Experts estimate that between 2-10% of those on death row have this disability. Mentally retarded offenders are incapable of understanding the wrongness of their crime.

Moratorium: a growing movement
Article Abstract:
Evidence of a growing movement for a moratorium on the US death penalty is discussed. DNA evidence has resulted in some death row exonerations and incompetent legal representation, race discrimination in death sentence processes, and even the execution of mentally retarded offenders persists.
