Microsoft's claim that its patents protect the firm from federal antitrust law is being examined in a settlement hearing being conducted by Thomas Penfield Jackson. The copyright claim will be central is Microsoft seeks to appeal the judgement against it. Jackson, however, stated that copyright law does not apply to the predatory behavior that Microsoft is accused of.

Microsoft finds itself facing two new lawsuits, both of which hope to become class-action suits. The suits allege that the software firm overcharged customers for Windows and MS Office software, based on comparisons of similar applications that can be purchased for much less. Microsoft states these latest charges are without merit.

U.S. hires investment-bank boutique for advice in Microsoft antitrust case
Article Abstract:
The Justice Dept. has retained investment banker Greenhill and Co. to help it analyze possible remedies in the Microsoft case. Since Judge Thomas Penfield Jackson's preliminary finding, that Microsoft had engaged in monopolistic behavior, observers have been speculating about the outcome of the case. Microsoft will have to either change the way it does business or restructure. On Wall Street, other investment bankers said they'd hesitate to appear on the government's behalf against Microsoft. They said they were afraid it might hurt their reputation within the technology industry.
