Issues are presented concerning the provisions of the Family Law Amendment Act which can be used for the establishment of financial agreements between couples. The difficulties divorcing couples experience with capital gains tax is discussed.

Coopers & Lybrand partner Michael Forsdick is hopeful that Australia's new spouse superannuation provisions will trigger legislative changes concerning the way courts can treat superannuation funds in divorce settlements. Though the government has been considering legislation that would allow the division of superannuation funds, little progress has been made.

Divorce law, millennium style
Article Abstract:
Proposed Australian divorce law reform will reflect societal changes and will limit the powers of the Family Court, especially in terms of financial and property agreements and the division of superannuation funds. Family courts currently have the power to divide property 50/50, and new legislation may require the courts to provide detailed explanations for any variance. A proposed 50/50 split of superannuation funds will allow more women to receive assets. The Family Court also has the authority to override financial agreements between couples.
