Sports memorabilia store goes to trial
Article Abstract:
Electronic Boutique's lawsuit for violation of a noncompete agreement against Robert Rosenfeld, owner of Batters Box, has been scheduled for a hearing in Aug. 1998 by Delaware Chancery Court Judge Stephen Lamb. Rosenfeld made an agreement in 1995 not to compete for five years and within 100 miles with Prime Time Inc. after selling his memorabilia shop, Collector's Depot in Christiana, DE, to Prime Time. When Electronic Boutique acquired Prime Time, Rosenfeld, who said he thought he was no longer obligated by their noncompete agreement, opened Batters Box on Kirkwood Highway in Dec. 1997. Stuart Grant, the lawyer for Electronic Boutique, claims the noncompete contract was flexible enough to protect the subsidiary of Electronic Boutique's memorabilia shop, Brandywine Collectibles, in Bear, DE, where the former owners of Prime Time now work.
