Indonesian prosecutors will find it difficult to prove that 66-year-old Muslim cleric Abu Bakar Bashir headed the Islamic network, which was blamed for the October 2002 Bali bombings that killed 202 people. The cleric has filed a lawsuit accusing the government of wrongful arrest and prosecutors will rely on evidence of jailed militants and a document seized by the police to counter this claim.

Indonesia is in an odd position in its efforts to crack down on terrorism. Since Jemaah Islamiah, the Muslim extremist group that orchestrated the car bombing in Bali that killed at least 202 people, is not legally registered. Therefore, by Indonesian law, the group does not exist, and the government is hampered in its efforts to break up this subversive group.

Article Abstract:
The problems concerned with the retroactive use of anti-terrorism laws are discussed in the context of the investigations of Bali bombings of October 2002. The Indonesia's Constitutional Court ruling on the use of Indonesian terrorism laws divides the legal fraternity but comes too late for convicted bombers.
