Challenging an adjudicator's decision may be a long process

The process of adjudication in the UK construction industry is beginning to encounter challenges. It is clear that the courts will probably not consider challenges to an adjudicator's decision solely on the merits. If one party disputes the adjudicator's view of a particular issue, it will have to accept this view until it is subsequently reconsidered in court or arbitration. If a decision is to be overturned, this must be on the basis that it was invalid in some way. At present, those who wish to challenge an adjudicator's decision should do nothing until steps are taken to enforce it in court.
