Civil liability for damage caused by waste
Article Abstract:
The European Commission (EC) has issued a draft Directive that outlines its policy on civil liability for damage caused by waste. The Directive covers property damage, personal injury, and death, caused directly or indirectly by improperly disposed waste. It also specifies that the producer of the waste becomes fully reponsible for the damage even if the producer is not directly responsible for the actual disposal of the waste. The Directive applies to all commercial establishments within the EC and is a landmark piece of environmental legislation that should have a profound impact on industry.
