Inefficient administration of justice in Indonesia's courts thwarts country's sound bankruptcy laws
Article Abstract:
The inefficient administration of justice is the main hindrance in pursuing bankruptcy cases in Indonesia. Indonesia's bankruptcy laws are based on the Dutch Bankruptcy Act of 1896 and is generally regarded by business observers as one of the best written law on bankruptcy. Indonesia's poor and inefficient justice system deters many businesses from pursuing bankruptcy cases. Much of the deterioration in the Indonesian justice system stems from the poor pay received by judges, which quenches the aspiration of young and talented lawyers from the position.

Indonesia's phoenix?
Article Abstract:
The Indonesian economy may benefit from the country's new bankruptcy law, even though this law has some negative aspects. It is likely that there will be a series of bankruptcies when the law comes into effect on Aug 20, 1998, as it will be easy for an unpaid creditor to submit a bankruptcy petition against a company. The aspect of this legislation that is a cause for concern is the fact that it denies a forum for presenting proper legal arguments.
