Article Abstract:
Lawyers involved in a settlement won by Texas, Mississippi and Florida from tobacco companies have been awarded $8.1 billion by an arbitration panel. Fees will be set for other lawyers, and the same criteria are likely to be used. This could fund mass litigation on other public health issues, against alcohol and other industries, and action is already being taken against gun producers. Lawyers can be seen as levying a tax paid for by smokers, which is also levied by tobacco firms and states.

The treatment of tobacco companies in the US focuses too much on punishment, and a regime which involves control and taxation with discouragement could help with tackling illegal drug abuse.
