Microsoft seeks dismissal of case

Microsoft Corp. is seeking for a dismissal of a pair of landmark antitrust lawsuits on grounds that the US government cannot establish the essential elements in any of its claims. The software maker said in an 88-page motion for summary judgment the government fail to prove its case. Microsoft said lawsuits filed by US Justice Department and 20 states must be thrown out due to issues demonstrated by the key factual proposition, not subject to genuine dispute. The company is charged with engaging in a pattern of predatory practices to retain a monopoly in operating-system software and to falsely expand that monopoly into the Internet software market.

Microsoft Corp. has been charged by the US Justice Department and 20 states with unlawfully pressuring Apple Computer Inc., Intel Corp., and others to terminate new technologies and restrict competition. The allegations place Microsoft chairman Bill Gates at the core of these actions. Prosecutors claim that the moves are an attempt by Microsoft to defend and expand its operating systems software monopoly.
